ATG Issues Three Millionth Title Insurance Policy

It's been a banner year for ATG; in the midst of celebrating our 50th anniversary — we issued our three millionth policy!

The insureds are William and Jill Thompson of Oglesby, Illinois, and the member attorney who issued the policy is Dick Fiocchi of Bernabei, Balestri & Fiocchi, Spring Valley, Illinois.

Real Estate Closings: Wired Funds and "Good Funds" — The Illinois definition of good funds does not explicitly require wire transfers, but the limits on electronic transfers effectively limit good funds to wire transfers. Understanding the distinction between electronic transfers considered “good funds” and those that are not is critical when conducting a real estate closing.

Mortgage Foreclosure: 1010 Lake Shore Association v Deutsche Bank — Under Section 9(g)(3) of the Condominium Property Act, an association's lien for unpaid assessments from before the judicial sale may still be due from the purchaser of the judicial sale if that purchaser failed to pay assessments due after the judicial sale.


Mortgage Foreclosure: Lunsford v Deutsche Bank Trust — Mortgage liens recorded before land contracts are superior between the two.


Takings: Village of Brown Deer v Balisterri — Village of Brown Deer street improvement did not amount to an unconstitutional taking, even though the majority, but not the entire, of the unrecorded street was 66 feet wide.
