We are proud to announce that ATG LegalServe, a subsidiary of Attorneys' Title Guaranty Fund, Inc., and It's Your Serve, Inc. (IYS) have combined to create a single, full-service litigation support company offering services to lawyers and law firms throughout Chicago and beyond.

Effective February 11, 2016, the blended organization is doing business under the name ATG LegalServe. Each organization will remain at its current downtown Chicago office until we relocate to a new corporate headquarters. Real Estate and Title Insurance News

PACA/PSA Trusts and Title Insurance — There is much concern about the sellers’ trusts, or super liens, resulting from the Perishable Agricultural Commodities Act and the Packers and Stockyards Act. Case law in this area with regards to title insurance is non-existent. Learn steps to prevent potential problems when insuring a title that is susceptible to one of these trusts.

Property Fraud Alert System: Public Act 99-0075 — Provides ways a property owner can be registered on a county's alert system as well as defines limits on liability and home rule powers.

RESPA: Chultem v Ticor Title Insurance Co — The attorney agents of defendant title companies did not violate RESPA in that they did perform services to earn their payment from the title companies; the reasonableness of the amount paid to the attorney agents is irrelevant.

Indiana

Lis Pendens: JPMorgan Chase Bank, NA v Claybridge Homeowners Association — A lis pendens notice can provide constructive notice for the successor mortgagee of a foreclosure on an enforceable, unrecorded judgment lien.

Wisconsin

Liens: Prince Corp v Vandenberg — A lien can attach to one debtor’s interest in real property, though the property is owned by several people as tenants in common.
