Common Trust Problems and Solutions — Take a look at four common problems that occur regarding trusts under Illinois law.

Legislative Update

Foreclosure: Public Act 98-0514 (IL) — Amends statutes protecting tenants in foreclosed homes.

Mortgage Foreclosure: Bank of New York v Langman — Filing of a lis pendens gives constructive notice to every mortgagor acquiring a lien on the land or every person subsequently acquiring an interest in the land, even a bona fide purchaser.

Mortgages: Blocker v US Bank — Mortgagor’s three attempts to pay off the balance of a loan in default were deemed insufficient for failure to provide legally acceptable funds.

Adverse Possession: Kees v Northern States Power Co — Landowners and a power company disputed a strip of land where a railroad was constructed many years earlier. The landowners' claims that under federal law, the strip of land had been abandoned and reverted back to the landowners, or alternatively, under Wisconsin law, they had adversely possessed the land, were dismissed.
