Judgment Liens

PA 96-0305, House Bill 3726, Effective Date: August 11, 2009. Amends: 735 ILCS 5/2-1602(a), 735 ILCS 5/13-218.

This Illinois law concerns revival of a judgment. Previously, 735 ILCS 5/2-1602(a) provided that a judgment may be revived in the seventh year after its entry, or in the seventh year after its last revival, or at any other time thereafter. Now, that provision reads that a petition to revive a judgment may be filed at the same prescribed time, but instead of "at any time thereafter," it may be filed "at any time within 20 years after its entry if the judgment becomes dormant."

Furthermore, 735 ILCS 5/13-218, which previously referred to "[j]udgments by a circuit court," now refers to petitions to revive judgments under 2-1602(a). It also provides that these petitions may be filed no later than "20 years next after the date of entry of such judgment."

Both amended provisions state that the act is declarative of existing law.
