Expansion of the Illinois Anti-Predatory Lending Database Program
 
Effective Date: July 1, 2010
 
The Illinois Anti-Predatory Lending Database (APLD) program will go into effect for Kane, Peoria, and Will Counties on July 1, 2010. The intention of the program is to reduce predatory lending practices by requiring certain borrowers to receive counseling before proceeding to closing. After completing the state-mandated counseling, the borrowers can then choose whether to continue with the loan transaction. Cook County has been subject to the Act since 2008.
 
All ATG members who conduct closings on property located Kane, Peoria, and Will counties must register with the State of Illinois (this is done through ATG) and complete a training session. To complete these steps, visit ATG's Anti-Predatory Lending Database Program web page. Once there you will find the following information:
 
  • How to register with State of Illinois (required for all agents conducting closings in affected counties);
  • Where to register for training (required for all agents conducting closings in affected counties);
  • Relevant ATG Forms;
  • Purpose of the Anti-Predatory Lending Database Program;
  • Transactions that are subject to the program;
  • Recording requirements; and
  • Database, counseling, and printing certificates.
