Title Tips: Representing a Buyer in an REO? Provide a Survey

Many attorneys now find themselves representing buyers in REO transactions. (An REO transaction is the sale of real estate owned by a lender following a foreclosure.) Typical REO contracts provide that the seller does not obtain or provide a survey. However, without a survey, ATG is not able to provide extended coverage.

To obtain extended coverage, the buyer must pay for and provide to ATG a survey. ATG has denied several recent claims for property defects that would have been disclosed by a survey.
