Title Tips: Documents Must be in Proper Form to Avoid Additional Recording Fees

 

Make sure that all documents that are to be recorded in connection with a closing conform with the requirements outlined at 55 ILCS 5/3-5018. Some county recorders are scrutinize the documents being submitted, and if they  do not conform with the recording requirements, the recorders charge additional fees . ATG has recently seen violations of the following parameters, which are specified in the above-referenced statute: 

  • The document should be on paper that measures 8.5 inches by 11 inches.
  • The document should be on white paper of not less than 20-pound weight.
  •  The document must have a one-half inch margin on the top, bottom, and on each side.
  • The top right of the first page should have a blank space that is 3 inches by 5 inches.
